The DOC’s official announcement revoking the antidumping (AD) order against magnesium metal from Russia will be published in Thursday.
The effective date of revocation is April 15, 2010 – which is the fifth anniversary of the publication date of the AD order.
Accordingly, the DOC will send instructions to U.S . Customs and Border Protection to (a) terminate the suspension of liquidation of merchandise subject to the order which was entered, or withdrawn from a customs-bonded warehouse, for consumption on or after April 15, 2010 and (b) return any dumping duties that were deposited on such entries made on or after April 15, 2010.
The DOC will complete the pending fifth administrative review of the AD order against Russia because the period covered by the review (i.e . , April 1, 2009 – March 31, 2010) preceded the April 15, 2010 effective date of revocation.
Here is the summary of the official notice,
On March 1, 2010, the Department of Commerce (the Department) initiated and the International Trade Commission (ITC) instituted the sunset review of the antidumping duty order on magnesium metal from the Russian Federation. On February 10, 2011, the ITC determined that revocation of this antidumping duty order would not be likely to lead to continuation or recurrence of material injury to an industry in the United States within a reasonably foreseeable time . Therefore, the Department is revoking the antidumping duty order on magnesium metal from the Russian Federation.
